Welcome to Property Insights (propertyinsights.co.uk). By accessing or using our platform, you agree to comply with and be bound by the following Terms and Conditions. If you do not agree with these terms, please do not use our services.
1. About Us
Property Insights provides property data, APIs, analysis and tools using public, government and third-party data, together with calculations and analysis produced by us. Access may be provided through a subscription, trial or one-off purchase.
2. Account Registration & Access
You must provide accurate information when creating an account and keep that information current.
Your account grants access only to the services, allowances and tools included in your plan, trial or purchase.
You are responsible for all activity under your account and for keeping passwords and API keys confidential. You must not share account credentials or API keys unless your plan or a separate written agreement expressly permits it.
You must notify us promptly if you believe that your account or API key has been accessed or used without authorisation.
3. Pricing, Payments & Cancellations
We may offer monthly or annual subscriptions, free trials and one-off purchases.
Payments are processed securely through Stripe.
Unless stated otherwise at checkout, subscriptions renew automatically for the selected billing period until cancelled.
You may cancel your subscription at any time. Cancellation takes effect at the end of the active billing period, and access will continue until that period ends.
Fees are non-refundable except where required by law or expressly stated in these Terms or at checkout.
Where a trial converts to a paid subscription, the trial length, price and first billing date will be shown before you complete checkout.
4. Acceptable Use
By using Property Insights, you agree that you will not:
- Scrape, resell, sublicense or distribute our data without permission.
- Use the platform in any unlawful or unauthorised way.
- Misrepresent our data as your own.
- Attempt to bypass security, authentication, rate limits, credit controls or access restrictions.
- Use the services to create or maintain a competing property dataset or service unless agreed with us in writing.
You may use the data:
- Internally within your business or for property analysis.
- Download data for internal processing and decision-making where your plan permits downloads.
- If you are an API customer, use or present our data to your customers only where your plan permits it or where agreed with us in writing.
5. API Business Use
Our API services are supplied for business use. By obtaining an API key, purchasing API access or using an API, you confirm that you are acting wholly or mainly for purposes relating to your trade, business, craft or profession and not as a consumer.
You confirm that you have authority to accept these Terms on behalf of any business or organisation for which you use the API services.
If you intend to use the API services as a consumer, you must contact us before purchasing or using API access. Nothing in these Terms affects rights that cannot lawfully be excluded.
6. Nature of API Data
Our APIs may combine information obtained from government bodies, public records, commercial providers and other third-party sources with calculations, matching processes, estimates and analysis produced by Property Insights.
Although we take reasonable steps to operate the API services as described, we do not warrant that data will be complete, accurate, current, unique, error-free or available at any particular time.
Data may be delayed, incomplete, incorrectly matched, based on estimates or affected by errors in an underlying source. Historical information may not reflect the current condition, ownership, legal status, planning position, market value or use of a property.
Data may be corrected, withdrawn or changed without notice when an underlying source changes or when we identify an error.
Unless expressly stated in a separate written agreement, the API services are not supplied with a service-level guarantee.
7. Information Only and No Professional Advice
The data is provided for general information and initial research purposes only. It does not constitute:
- Legal, conveyancing or planning advice.
- Financial, tax, mortgage or investment advice.
- A professional property valuation.
- Structural, environmental or surveying advice.
- Confirmation of ownership, title, boundaries or permitted use.
- Confirmation that planning permission, finance or insurance will be available.
- A recommendation to purchase, sell, develop, finance or otherwise deal with a property.
No API response should be treated as a substitute for official searches, inspections, professional valuations, legal advice or other appropriate due diligence.
Property Insights does not act as your adviser, agent, fiduciary, surveyor, valuer or decision-maker.
8. Customer Responsibility and Reliance
You are responsible for:
- Determining whether the data is suitable for your intended purpose.
- Independently checking information that may affect a property or business decision.
- Obtaining appropriate professional advice.
- Reviewing the source, date, coverage and limitations of the data.
- Testing your implementation and interpretation of API responses.
- Deciding whether to take or refrain from any action.
You accept that property and business decisions involve risks that cannot be assessed using API data alone.
You remain responsible for decisions made by you, your employees, contractors, customers and end users, including decisions involving purchases, sales, valuations, lending, insurance, planning, development and investment.
You must not represent that Property Insights has approved, guaranteed or recommended a property, valuation, transaction or business decision.
9. Onward Use
You may provide or display data to your customers or end users only where this is expressly permitted by your plan or agreed with us in writing.
Where onward use is permitted, you are responsible for:
- The product, report, application or service through which the data is supplied.
- Explaining the nature and limitations of the data.
- Ensuring that your customers do not treat the data as professional advice.
- Maintaining appropriate terms, disclaimers and privacy information for your customers.
- Complying with applicable laws and third-party data licence requirements.
- Responding to claims relating to your product, advice, presentation or interpretation of the data.
You must give end users a clear notice that property information may come from public and third-party sources, may be incomplete, delayed or inaccurate, is provided for information only and should be independently verified before making a property, financial or business decision.
You must not alter, omit or present data in a way that is misleading or materially changes its meaning.
10. Intellectual Property & Content Ownership
Much of our data is sourced from public or government sources.
However, our platform, tools, visualisations, analysis and processed data are the property of Property Insights and protected under applicable laws.
You may not copy, republish, or redistribute content without permission, except as outlined above.
11. Availability and Changes
We may maintain, change, replace, restrict or discontinue an endpoint where reasonably required for security, legal, licensing, operational or commercial reasons.
Where reasonably practicable, we will provide advance notice of a material breaking change to a generally available paid endpoint.
We may suspend access immediately where necessary to protect the services or another customer, prevent suspected fraud or abuse, address a security incident, comply with a legal or data-provider requirement, or respond to non-payment or a material breach of these Terms.
We will not be responsible for a failure or delay caused by circumstances outside our reasonable control, including failures of public data services, third-party providers, hosting providers, telecommunications networks or internet infrastructure.
12. Exclusion and Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, Property Insights will have no liability arising from or connected with:
- Inaccurate, incomplete, delayed, unavailable or incorrectly matched data.
- Errors or omissions in public records or third-party data sources.
- Changes made by a public body or third-party data provider.
- Any decision, action or omission based on the data.
- A failure to independently verify the data.
- Your interpretation, modification or presentation of the data.
- Onward distribution or use of the data.
- Unauthorised use of an account or API key caused by your failure to protect your credentials.
- Interruption, suspension, modification or withdrawal of an API endpoint.
- Incompatibility between the API services and your systems.
Subject to the first paragraph of this section, Property Insights will not be liable for loss of profit, revenue, sales, anticipated savings, business, contracts, commercial opportunity, goodwill, reputation or data; wasted expenditure; business interruption; or indirect or consequential loss. This applies whether the loss was foreseeable and whether the claim arises in contract, tort, negligence, misrepresentation, breach of statutory duty or otherwise.
You acknowledge that the charges for the API services have been calculated on the basis that Property Insights will not accept responsibility for your property, financial or business decisions.
Fallback liability cap
If any complete exclusion of liability in this section is found to be invalid or unenforceable, Property Insights' total aggregate liability arising out of or in connection with the API services will not exceed the lower of the amount paid by you for the affected API services during the three months immediately before the event giving rise to the claim or £100.
The cap applies collectively to all claims arising from the same or related events and is not renewed for each individual claim.
Each exclusion and limitation is intended to operate separately. If one is found unenforceable, the remaining exclusions and limitations will continue to apply.
13. Customer Indemnity
You will indemnify Property Insights against third-party claims, losses, damages and reasonable legal costs to the extent caused by:
- Your unlawful or unauthorised use of the API services.
- Your breach of these Terms.
- Your modification, interpretation or misleading presentation of the data.
- Your onward sale, distribution or supply of the data.
- Advice or recommendations given by you using the data.
- Infringement of another person's rights by your application, service or implementation.
This indemnity will not apply to the extent that a claim was directly caused by Property Insights' fraud, fraudulent misrepresentation or another liability that cannot lawfully be excluded.
14. Termination
We reserve the right to suspend or terminate accounts that breach these Terms, misuse our data, or violate any applicable laws.
15. Governing Law
These Terms are governed by and interpreted in accordance with the laws of England and Wales. Subject to any rights that cannot lawfully be restricted, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms.
16. Changes to These Terms
We may update these Terms to reflect changes to our services, data licences, legal obligations or business practices. The updated Terms will be published on this page with a new effective date. Where a change materially affects an existing paid service, we will provide reasonable notice where practicable.
